नैनीतालः उत्तराखंड उच्च न्यायालय ने नौ साल की नाबालिग बच्ची का अपहरण कर दुष्कर्म के बाद हत्या करने पर निचली अदालत से फांसी की सजा के मामले में सुनवाई करते हुए अभियुक्त का केस लड़ने के लिए वरिष्ठ अधिवक्ता पुष्पा जोशी को न्यायमित्र नियुक्त किया है। कार्यवाहक मुख्य न्यायधीश संजय कुमार मिश्रा और न्यायमूर्ति आर. सी. खुल्बे की खण्डपीठ ने अगली सुनवाई चार सप्ताह बाद तय की है।
मामले के अनुसार हरिद्वार की पॉक्सो अदालत ने मुख्य अभियुक्त को फांसी की सजा की पुष्टि करने के आदेश उच्च न्यायलय के रजिस्ट्रार जनरल को भेजा था। उसके बाद उच्च न्यायलय की रजिस्ट्री द्वारा इस मामले पर आदेश की पुष्टि के लिए रिफरेंस अपील दायर की गई। निचली अदालत के आदेशानुसार पॉक्सो कोर्ट हरिद्वार ने अभियुक्त को फांसी की सजा के साथ साथ 1.30 लाख रुपए का अर्थदंड भी लगाया। वहीं सह अभियुक्त को कोर्ट ने 5 साल की सजा और एक लाख का अर्थदंड लगाया है। जबकि तीसरे अभियुक्तों को कोर्ट ने उनके खिलाफ कोई सबूत नही मिलने के आधार पर बरी कर दिया था।
मामले के अनुसार समाचार पत्रों में छपी खबरों के आधार पर हरिद्वार पुलिस ने अज्ञात लोगों के खिलाफ 20 दिसंबर 2020 को एक मुकदमा दर्ज किया। जाँच के बाद कोतवाली हरिद्वार ऋषिकुल कॉलोनी के एक मकान में 9 साल की बच्ची का शव बरामद किया । इस मामले में पुलिस ने मकान मालिक राजीव कुमार और उसके भांजे रामतीर्थ यादव को गिरफ्तार किया । बच्ची के पोस्टमार्टम से दुष्कर्म की पुष्टि हुई और बाद में उसका गला घोटकर हत्या की गई । दर्ज मुकदमे के अनुसार पीड़िता के पिता की तहरीर पर तीन आरोपी राम तीरथ यादव, राजीव कुमार और गंभीर चंद उर्फ गौरव निवासी ऋषिकुल हरिद्वार के खिलाफ मुकदमा दर्ज कराया गया। कहा गया था कि उनकी नौ वर्षीय मासूम लड़की घर गायब है।
